Minutes
Meeting was called to order by David Yeager, at time 7 p.m.

Proof of due notice was posted by Woody, at entrance and exit of Quail Valley location giving residents 48 hours notice of forthcoming meeting. Notice was also posted on the QVLOA web site.

Board members in attendance were as follows: David Yeager, Sally Osteen, Natalie Yancey and Kerry Postel (absent was Shawn Jones).

Karen Swingle from EPM Services was in attendance.

Minutes of the February 18, 2008 monthly Board of Directors meeting were approved by the Board by a motion being made and seconded and then unanimously agreed by the Board.

Treasurers Report (given by Karen Swingle)
  • Reported that the bank balance as at February 29, 2008 was $92,810.00 $12,860 in the operation account and the balance of $79,950 in the money market account.
  • Past due — 167 homeowners in arrears, represents about one third of the homes in Quail Valley. That is for 2007 and 2008. People still have a grace period until the end of March 2008 to pay their 2008 dues. 57 certified letters were sent out for 2007 dues, 24 people responded which is 42%. 16 people have until March 31, 2008 to pay their 2007 dues. 9 homes are in foreclosure and 3 are with the attorney.
  • Liens — A motion was made by Natalie and seconded by Sally for the 33 homes that did not respond to the recent certified letter to be sent to the attorney for a lien to be filed against those homes.
  • It was also brought to the attention of the Board that our current attorney is very expensive at a charge of $250 per hour. A new attorney was brought to the attention of the Board and he would charge $100 for filing a lien, this is a flat rate. A motion was made by Kerry and Natalie and seconded to use this new attorney and to instruct him to file liens on the 33 homes that did not respond to the recent certified letter. This would be at a cost of $3300.00 total.

Audience were asked if anyone was waiting for anything else from the ARB — no one did.

Violation summary:
Karen Swingle and Sally Osteen now ride around together each month to do the drive through; this makes sure that we are only sending letters for violations according to our covenants.

The main problem appears to be the roofs, it was first thought that this was algae but it appears that it might not be but more to do with the deterioration of the shingles themselves. It was agreed that we would send information out with these letters to assist the homeowner in rectifying this problem. A disclaimer will be included in the letter so that Quail Valley does not look like it is endorsing these companies but just assisting the homeowners. It was noted that it appears to be seen on the darker color shingles. It was also discussed about going back to the roofing company that installed the roofs at the time of construction and researching the warranty option.

A boat was seen on a driveway and 2 homes were noted to have fading paint.

Painted driveways still exist in Quail Valley. The house with the painted driveway on Carlisle with sealant has said that he did the driveway 2 years ago and that he will come to the Board if he is told to correct it. The other 2 homes on La Costa with painted driveways are working on it to rectify this situation. Sally Osteen is giving them a little bit of time to get this done.

It was noticed that the landscaping overall was looking much better.

Jennifer Bode brought to the attention of the Board the tall grass that is still around a retention pond behind La Costa. Karen Swingle to check this out and report back to the Board.

Karen Swingle will look into finding out the banks of the houses that are in foreclosure to request them to keep the yards tidy.

For Rent signs are not allowed, Sally will be contacting those homes to request them to remove the for rent signs.

Unfinished Business
Walgreen's update: David Yeager presented the timeline of events to do with the commencement of work at the Walgreen's site. He stated that he had an email from Tudor Ventures, the construction company, in January saying that if we want anything from that site to take it as they will be starting work very soon. So on January 28, the parents came by and said take whatever you want take everything. Then the parents said that they could reuse the letters but that is not what they said, they said we could take everything. So, we don’t own the property but we wanted to try and sell the trees. We were told that the magnolia trees were not worth anything and the oaks. We were able to sell the other trees for $550, the Board had agreed to take the money and allow them to take the trees. On March 17, the construction called David and said they have some problems can he help them. They said that they did not have their DEP permit or their DOT permit. The problem is that when you leave the subdivision they are supposed to change the lights so that there is a left turn arrow with turn lane. The City held them up as they did not have everything ready. David went to P&Z to find out what they needed. They would not be given their CO until they have their DEP and DOT permits. DEP permit is about how they are going to handle their waste. The only permit that they have at the moment is to push dirt and grade the site, remove the Quail Valley sign. David then was contacted again saying that they were concerned about the power going to the sign. David has already spoken to Karen to arrange for Progress Energy to remove the meter, which should be done this week. Walgreen's has to be open by September 2008. We have no power to do anything to get them to move faster, it is between the construction company and the City. If anyone has a problem with this then they need to contact Walgreen's. We have asked them to rebuild our entrance as soon as possible. They should start grading the land this week, the surveyors were there today.

The “No Soliciting” sign was replaced today, March 24, 2008. It is made of a thicker sign so it should last longer.

There will be a community yard sale on April 12, 2008 between 8 a.m.-2 p.m. A motion was made by Sally and seconded by Natalie to advertise in the News Leader. Woody will post signs at the exit and entrance advertising the yard sale. The QVLOA will pay for a community permit so that individuals do not need to get their own permit.

Karen asked for classification on the electronic receipt for certified letters versus a hard copy receipt. The cost savings versus the additional time that it may take to track this info online was discussed. It was agreed by a motion and a second that we would try the electronic receipt method for sending out the lien information on the 33 letters that will be sent this month. Karen will report back as to how this worked and if it worth us continuing this way.

A request was made for volunteers to get the Crime Watch program up and running. No one volunteered. There have been a number of cars and houses that have been damaged. It was suggested that Sally contact Lt. Link and request for someone to come and talk at a future QVLOA meeting and to inform us as to what is involved in getting the program set up. Comments were made about the number of people wandering through the backyards down by the lake. There are people down there that do not even live in Quail Valley. Some are fishing others are driving dirt bikes around. It was advised that residents need to call the Sheriff.

Kerry Postel agreed to email the approved February minutes to Bob Dempsey so that they can be posted on the QVLOA web site.

New Business
The position of Secretary is still open, no volunteers on the Board to fulfill this position at this time, to be discussed next time.

There is a missing street sign in the last phase. Sally Osteen said that it blew down in the strong winds that we experienced recently. Code Enforcement came out and they have the sign and will be replacing it.

It was also brought to the attention of the Board that there is no sidewalk to allow wheelchairs etc to cross the road at Gentle Breeze Drive and Tranquility. David will get Public Works to look at it.

A motion was made by Kerry and seconded by Sally to have a fixed schedule for the QVLOA meetings; they will be on the third Monday of the month unless it falls on a Holiday.

David Yeager informed us that the Waste Pro contract will not be changing. We will continue with 2 collections a week and using our regular garbage cans.

David Yeager reiterated again that if you have an issue — call him. He will not respond to emails, if you are not happy about something then call him. If he doesn’t know about the problem then he can’t do anything about it.

Sally Osteen made a motion to adjourn meeting. Kerry Postel 2nd the motion. All Board members voted in favor; meeting was adjourned at 8.15 p.m.
